1. Your agreement with us

These Terms are an agreement between you and Volyxis, the operator of Volyxis. They cover the Website, accounts, plans, licensing and build services, downloads, support and Bug Tracker. The separate End User Licence Agreement covers use of the Volyxis Editor and software included in a game build.

By creating an account, buying a plan or using these services, you agree to these Terms. If you act for an organisation, you confirm that you can accept them for that organisation.

2. Accounts

You must give accurate information, keep a working email address and protect your password, sessions and licence key. Tell Support promptly if you believe somebody else has access.

An account is for its holder unless a plan clearly includes more users or seats. Do not sell an account, share access outside the plan, evade device limits or pretend to be somebody else.

3. The service today

Volyxis provides tools for creating, testing, building and distributing games. Some parts are Beta, preview or still being developed. Current features can contain faults, change or be withdrawn. Keep independent project backups and test every game build before release.

We aim to keep online services available, but maintenance, security work and provider failures can interrupt them. Beta or current availability never removes a consumer right that applies by law.

4. Community Edition

Eligible verified accounts can use the free Community Edition to evaluate Volyxis and its core tools and build workflow before buying. Community builds must keep any Volyxis startup screen, protection or other requirement shown for that edition.

Community Edition does not give paid-plan benefits and does not override rights you have by law.

5. Paid plans and billing

Paid plans add the benefits shown on the Pricing page and at checkout. Checkout shows the plan, recurring price, currency, billing interval and applicable tax before you pay. Stripe processes the payment.

By completing checkout, you authorise the displayed payment and later recurring payments until the subscription is cancelled. If payment fails or is reversed, paid access may be restricted or end, subject to any notice or remedy required by law.

6. Renewal and cancellation

A subscription renews for the interval shown at checkout until you cancel it. You can cancel future renewal through the Stripe Customer Portal linked from your Billing page. The Portal and your account show when paid access ends.

Cancelling stops future renewal. Your current paid period continues until the end date shown in your account.

7. Immediate digital supply

If you ask for paid digital access or a download to begin during a statutory cancellation period, checkout will ask for your express request to begin supply and your acknowledgement that you may lose the 14-day cancellation right once supply begins.

Where the law requires those steps, your cancellation right is not lost unless they are completed. Contact Support if you want to exercise a statutory cancellation right.

8. No Refund Policy

We do not offer voluntary change-of-mind refunds once paid digital access has started, or pro-rata refunds if you cancel part-way through a billing period. Cancelling stops the next renewal; your current paid period continues. Community Edition is free, so you can evaluate Volyxis before paying.

This does not affect any rights you have by law.

9. Plan and price changes

We may add, retire or change plans. A change does not rewrite a completed order. Before a new recurring price or a significant reduction in a paid plan takes effect, we will give the notice and choice required by law. You can cancel before the change applies.

10. Acceptable use

Do not use Volyxis to break the law, infringe another person's rights, distribute malware, attack or overload a service, bypass security or rate limits, misuse a licence or paid feature, impersonate somebody, or publish another person's confidential information.

Report a suspected security weakness privately through Support. Do not test it against another user's account or production data.

11. Your content

You keep ownership of games, maps, scripts, models, textures, audio and other original work that you create or lawfully import. You are responsible for having the rights needed for third-party material and for the legality of a game you distribute.

When you deliberately submit content to support, the Bug Tracker or another Website feature, you allow us to store, copy and show it only as needed to provide that feature. Public Bug Reports can be shown publicly.

12. Volyxis ownership

Volyxis and its licensors own Volyxis, including the Website, Editor, engine, runtime, code, design, documentation and branding. Access is licensed, not sold. The EULA explains the software and runtime rights granted to you.

We may use feedback or suggestions you send us. Sending feedback does not transfer ownership of your game, assets or project.

13. Other services and software

Volyxis links to or uses services operated by others, including Stripe, Google reCAPTCHA, Discord, YouTube and Vimeo. Their own terms and privacy policies apply. Open-source and third-party software keeps the licence supplied with it.

14. Support, updates and changes

Support and product benefits are those shown for your plan. We may issue fixes, change compatible versions, retire an unsafe version or alter a Beta feature. We will use reasonable care and give notice or a remedy when the law requires it.

You are responsible for a supported device, internet access, project backups and testing after an update.

15. Suspension and termination

You may stop using Volyxis and can ask Support to close your account. Subscription cancellation is explained above.

We may restrict access to protect users or systems, investigate suspected abuse, deal with non-payment or obey the law. We may end access for a serious or repeated breach, fraud or unlawful use. We will give notice and a chance to put matters right when that is reasonable and lawful.

Ending access does not remove charges already due, ownership rights, lawful record keeping or mandatory consumer remedies. The EULA explains what happens to an existing game build.

16. Warranties and responsibility

We provide the services with reasonable care and skill where the law requires it. We do not promise that Volyxis will be free from every error, work with every device or asset, or meet every commercial goal.

You are responsible for backups, testing, content rights, ratings, platform rules, distribution and support for your own game. Nothing here excludes statutory standards or remedies that apply to a consumer.

17. Liability

We do not exclude liability for death or personal injury caused by negligence, fraud, or anything else that the law says cannot be excluded.

If you are a consumer, we are responsible for loss that was a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, business loss from consumer use, or damage you could reasonably have avoided by following instructions or keeping backups.

If you use Volyxis mainly for business, neither side is responsible for indirect loss or loss of profit, revenue, goodwill or opportunity where the law allows that limit. Our total liability for the affected services in any 12-month period is the greater of £100 and the amount you paid for those services in that period. This limit does not apply where the law does not allow it.

18. Law, disputes and changes

The laws of England and Wales govern these Terms. A consumer keeps the mandatory protection of the law where they live. Consumers in Scotland or Northern Ireland can also use their local courts. Business disputes are subject to the courts of England and Wales.

Please contact Support first so we can try to resolve a problem. We may update these Terms for product, security, provider or legal changes. We will publish the new version and date and give any further notice required by law. A new version does not remove a right you already have.
