1. Agreement and scope

This End User Licence Agreement is between you and Volyxis. It covers the Volyxis Editor, engine, runtime, templates, documentation and updates. The Terms of Service separately cover accounts, subscriptions and online services.

By downloading, installing or using the software, you agree to this EULA. If you act for an organisation, you confirm that you can accept it for that organisation.

2. What you may do

While your plan or licence is active and you follow this EULA, you may install and use the Editor on the supported devices and for the users allowed by your plan. You may use it to create, test and build your own games.

This is a limited, non-exclusive licence. The software is licensed, not sold. You cannot transfer or sublicense the Editor unless Volyxis agrees in writing or the law gives you that right.

3. Activation and devices

The Editor can require a verified account, licence key, device identifier, online activation and later checks. A signed activation can allow limited offline use. Build Game checks the plan and licence that apply when you make the build.

Keep account details and licence keys secure. Do not sell a key, copy an activation to another installation or alter device, time, signature, plan or licence information. Contact Support if a genuine device change cannot be completed through your account.

4. Community and paid use

Community Edition allows the features and build rules shown for that edition. A Community build must keep any required Volyxis startup screen or protection.

A paid plan adds only the benefits shown for that plan. Paid access can end after cancellation, expiry, payment failure, suspension or termination. Nothing in this section removes a mandatory consumer right.

5. Building and distributing games

You may use Build Game to make and distribute your own games. The build must follow the branding, protection and other rules shown for your plan when it is made.

You are responsible for testing the finished game and meeting the rules of each store, platform and country where you release it.

6. Your games and assets remain yours

You retain ownership of the games, maps, scripts, dialogue, models, textures, audio and other original work you create or lawfully import. Volyxis does not acquire ownership of your game or creative work because you used Volyxis.

You are responsible for permissions for third-party assets, fonts, music, code and other material. Keep independent backups of projects and source assets.

7. Volyxis runtime in a game

A game built with Volyxis can include designated Volyxis engine and runtime components. You may copy and distribute those components worldwide, without a separate royalty, in object-code form and only as an inseparable part of that game. Required notices, protection and startup screens must remain.

You may give players the rights needed to install and run the game. You may not distribute the Editor, standalone runtime libraries, source code, development tools or reusable Volyxis components.

If this licence later ends, a game validly built while it was active can normally continue to be distributed. That does not apply to a fraudulent or unlawful build or one made in serious breach. You cannot make new builds or updates after your plan or licence access ends.

8. Restrictions

You must not sell, rent, publish or redistribute the standalone Editor; share it beyond the people or devices a plan allows; bypass activation, paid controls, required branding or build protection; forge a licence or build record; remove a required ownership notice; or use the software for malware or unlawful content.

Do not reverse engineer, decompile or disassemble the software except where a mandatory right in law allows it, including a right needed for interoperability. Contact Support if you need interoperability information.

9. Copies, backups and your responsibilities

You may keep reasonable backup copies for your own licensed use. Do not use a backup to give another person access.

You are responsible for project backups, testing, game security, content rights, privacy, age ratings, export rules, distribution and support for your players.

10. Updates and Beta software

We may provide fixes, security updates and new versions. An update can change compatibility, supported operating systems or a Beta feature. We may require an update where an old version is unsafe or no longer works with activation or build services.

Beta, preview or experimental software can be incomplete or unstable. Use it on backed-up projects and test its output. These warnings do not remove rights or remedies that the law gives you.

11. Third-party software

Volyxis includes open-source and other third-party software. Its notices and licences apply to those components and can give you extra rights. Example assets or optional downloads may have separate terms, so check them before redistribution.

12. Online services and support

Downloads, activation, build checks and support depend on online services and third-party infrastructure. Support is provided at the level shown for your plan. We do not promise uninterrupted availability, but we use reasonable care and skill where the law requires it.

Do not include passwords, full licence keys, payment-card details or unnecessary personal information in diagnostics. The Privacy Policy explains how support information and screenshots are handled.

13. Ending this licence

You can end this licence by stopping use and deleting the Editor. Rights that depend on an active plan or licence can end when your account or plan ends.

We may suspend or end the licence for a serious or repeated breach, licence fraud, unlawful use, non-payment or a serious security risk. We will give notice and a reasonable chance to put matters right where that is appropriate and lawful. You must then stop using and delete software not validly included in an existing game.

Ownership, restrictions and valid existing runtime rights continue where needed. Mandatory consumer rights remain unaffected.

14. Warranty and responsibility

We provide the software with reasonable care and skill where the law requires it. We do not promise that it will be free from every error, compatible with every device or asset, or suitable for a safety-critical or regulated use.

Nothing in this EULA excludes statutory quality standards or remedies available to a consumer.

15. Liability

We do not exclude liability for death or personal injury caused by negligence, fraud, or anything else that the law says cannot be excluded.

If you are a consumer, we are responsible for loss that was a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, business loss from consumer use, or damage you could reasonably have avoided by installing a fix, following instructions or keeping backups.

For mainly business use, neither side is responsible for indirect loss or loss of profit, revenue, goodwill or opportunity where the law permits that limit. Our total liability for the software in any 12-month period is the greater of £100 and the amount you paid for the affected software or plan in that period. This limit does not apply where the law does not allow it.

16. Law, changes and contact

The laws of England and Wales govern this EULA. A consumer keeps the mandatory protection of the law where they live. Consumers in Scotland or Northern Ireland can also use their local courts. Business disputes are subject to the courts of England and Wales.

We may update this EULA for product, security, licensing or legal changes. We will publish the new version and date and give any further notice required by law. An update does not take away rights already gained in a valid build or any mandatory consumer right.
